Welcome to mybeautymaster. These Terms and Conditions ("Terms") govern your access to and use of the mybeautymaster platform, including our website, mobile applications, and all related services (collectively, the "Platform"). Please read these Terms carefully before using our Platform.

1. Acceptance of terms

By accessing, browsing, or using the mybeautymaster Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules applicable to specific services. If you do not agree to these Terms, you must not use the Platform.

You must be at least eighteen (18) years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing or using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. Definitions

The following terms shall have the meanings set out below throughout these Terms and Conditions:

  • "Platform" means the mybeautymaster website, mobile applications, APIs, and all related technology and services operated by mybeautymaster.
  • "Service Provider" or "Beauty Professional" means any independent contractor, sole proprietor, or business entity that offers beauty services through the Platform.
  • "Customer" means any individual who uses the Platform to browse, book, or receive beauty services.
  • "Services" means the beauty treatments and services listed on the Platform by Service Providers, including but not limited to hair styling, nail care, lash extensions, makeup application, skincare treatments, waxing, and other personal care services.
  • "Booking" means a confirmed appointment between a Customer and a Service Provider arranged through the Platform.
  • "Service Location" means the physical location designated by the Customer where the beauty services are to be performed, which may include the Customer's home, hotel, office, event venue, or other agreed-upon premises.
  • "User" means any person who accesses or uses the Platform, whether as a Customer, Service Provider, or visitor.

3. Platform description

mybeautymaster operates as a multi-vendor online marketplace that connects Customers seeking beauty services with independent Beauty Professionals who offer those services. The Platform facilitates the discovery, booking, communication, and payment processes between Customers and Service Providers.

mybeautymaster is not a beauty service provider. We do not employ, direct, or control Service Providers. All Service Providers using the Platform are independent contractors or independent business operators. No employment, partnership, joint venture, or agency relationship is created between mybeautymaster and any Service Provider by virtue of their use of the Platform.

mybeautymaster does not guarantee the availability, quality, safety, legality, or suitability of any services offered on the Platform. Users acknowledge that they use the Platform and engage with other Users at their own discretion and risk.

4. Account registration

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information to keep it accurate, current, and complete.
  • Maintain the security and confidentiality of your login credentials and account access.
  • Accept responsibility for all activities that occur under your account.
  • Notify mybeautymaster immediately of any unauthorized use of your account or any other breach of security.

You may only maintain one account per person. mybeautymaster may require identity verification, including through passkeys, phone number verification, or other authentication methods. We reserve the right to suspend, disable, or terminate any account at any time if we reasonably believe it has been used in violation of these Terms.

5. Service provider obligations

By listing services on mybeautymaster, each Service Provider represents, warrants, and agrees to the following:

Licensing and certification

  • You hold all licences, permits, certifications, and professional qualifications required by applicable federal, provincial, and municipal laws to perform the beauty services you offer.
  • You will maintain all such licences and certifications in good standing for the duration of your use of the Platform.
  • You will promptly notify mybeautymaster if any required licence, permit, or certification is suspended, revoked, or expires.

Insurance

  • You will obtain and maintain appropriate professional liability insurance and general commercial liability insurance adequate to cover your activities on the Platform.
  • mybeautymaster may request proof of insurance at any time, and failure to provide it may result in suspension of your account.

Service listings

  • You will provide accurate, complete, and truthful descriptions of your services, including pricing, duration, and any conditions or limitations.
  • You will keep your availability calendar up to date and respond to booking requests in a timely manner.
  • You will arrive at the Service Location at the agreed-upon time and perform services as described in your listing.

Professional conduct and compliance

  • You will comply with all applicable health and safety regulations, sanitation standards, and industry best practices.
  • You will bring your own supplies, products, tools, and equipment unless otherwise agreed upon with the Customer in advance.
  • You are solely responsible for your own tax obligations, including income tax, sales tax (GST/HST/PST), and any other applicable taxes.
  • You will maintain professional conduct at all times and will not engage in behaviour that is discriminatory, harassing, threatening, or otherwise inappropriate.
  • You will not solicit Customers to complete transactions outside of the Platform or to circumvent the Platform's payment processing.

6. Customer obligations

By using the Platform to book services, each Customer represents, warrants, and agrees to the following:

  • You will provide an accurate and complete Service Location address and any necessary access instructions, including building entry codes, parking information, and unit numbers.
  • You will ensure the Service Location is safe, clean, well-lit, and reasonably suitable for the requested beauty service, including adequate workspace, access to water and electricity where needed, and a stable surface for equipment.
  • You will be present and available at the designated Service Location at the scheduled booking time.
  • You will disclose any relevant health conditions, allergies, skin sensitivities, or medical treatments that may affect the safe delivery of services.
  • You will treat Service Providers with courtesy, respect, and professionalism at all times.
  • You will not request services that are illegal, outside the scope of the Booking, or that require the Service Provider to act beyond their area of professional qualification.
  • You accept responsibility for any damage to the Service Provider's equipment or supplies caused by your negligence or that of persons at the Service Location.

7. At-home & mobile services

A core feature of mybeautymaster is the delivery of beauty services at the Customer's chosen location. The following provisions apply specifically to at-home and mobile service delivery:

Service location

  • Services may be delivered at the Customer's home, hotel room, office, event venue, or any other location mutually agreed upon between the Customer and Service Provider.
  • The Customer is responsible for ensuring that the Service Location provides a suitable workspace, including adequate space, lighting, ventilation, access to running water, and electrical outlets as may be required for the specific service booked.
  • The Platform provides communication tools to enable pre-service coordination between the Customer and Service Provider regarding location details and workspace requirements.

Safety

  • A Service Provider may refuse to perform services if, in their reasonable professional judgment, the Service Location is unsafe, unsanitary, or otherwise unsuitable for service delivery. In such cases, the cancellation policy for the Booking may apply.
  • Neither Customers nor Service Providers should engage in any behaviour that makes the other party feel unsafe or uncomfortable. Any such incidents should be reported to mybeautymaster immediately.
  • In the event of an emergency at the Service Location, both parties should contact local emergency services (911) first, then notify mybeautymaster.
  • mybeautymaster is not responsible for any injury, loss, or damage arising from the condition of the Service Location, the conduct of any party at the Service Location, or any third-party actions at or near the Service Location.

8. Booking & cancellation

Booking confirmation

A Booking is confirmed when both the Customer and Service Provider accept the appointment and payment has been authorized through the Platform. Until a Booking is confirmed, no obligation exists between the parties.

Cancellation policies

  • Individual Service Providers set their own cancellation policies, which are displayed on their service listings and at the time of Booking. Customers are responsible for reviewing and understanding the applicable cancellation policy before confirming a Booking.
  • Customers who cancel within the Service Provider's cancellation window may be charged a cancellation fee as specified in the applicable policy.
  • Service Providers who cancel a confirmed Booking must provide reasonable advance notice to the Customer. Repeated cancellations by a Service Provider may result in account penalties, reduced visibility, or suspension.
  • No-shows by Customers (failure to be present and available at the Service Location at the scheduled time) may result in a charge up to the full service price, at the discretion of the Service Provider's cancellation policy.

Mediation

mybeautymaster may, at its sole discretion, mediate cancellation or no-show disputes between Customers and Service Providers. However, mybeautymaster is not obligated to issue refunds for cancellations governed by a Service Provider's policy.

9. Payment terms

  • All payments on the Platform are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. mybeautymaster does not directly store, process, or have access to your full credit card or debit card numbers.
  • Prices are displayed in the currency set by the Service Provider. The default currency is Canadian Dollars (CAD). All prices shown are inclusive of the service fee unless otherwise stated.
  • Payment is authorized at the time of Booking and captured upon confirmation of service completion or as specified in the Booking terms.
  • Platform service fees and commissions will be clearly disclosed to both parties before the Booking is confirmed. The Platform deducts its commission from the service price before disbursing the remainder to the Service Provider.
  • Service Providers receive payouts via Stripe Connect directly to their connected bank account. Payout timing and frequency are governed by Stripe's policies and the Service Provider's Stripe Connect account settings.
  • Refund eligibility is determined by the applicable cancellation policy, and refunds are processed through the original payment method via Stripe.
  • Customers are responsible for any additional charges mutually agreed upon with the Service Provider during the service (e.g., upgraded products, additional treatments). Such charges must be processed through the Platform.
  • Tips and gratuities are entirely optional, voluntary, and go directly to the Service Provider. mybeautymaster does not take a commission on tips.

10. Marketplace liability limitations

mybeautymaster is a technology marketplace platform and is not a party to the service agreement between Customers and Service Providers. To the maximum extent permitted by applicable law:

  • mybeautymaster does not guarantee, endorse, or warrant the quality, safety, legality, timeliness, or suitability of any services offered by Service Providers on the Platform.
  • mybeautymaster does not verify or endorse Service Provider qualifications, certifications, licences, or insurance beyond any basic verification processes described on the Platform. Users should independently verify any credentials they consider material.
  • Service Providers are independent contractors. mybeautymaster does not employ, supervise, direct, or control Service Providers or the manner in which they perform services.
  • mybeautymaster shall not be liable for any personal injury, property damage, loss of belongings, allergic reactions, skin irritation, infection, or any other harm or loss arising from or related to services performed by Service Providers, conditions at the Service Location, or interactions between Users.
  • mybeautymaster is not responsible for resolving disputes between Customers and Service Providers, although we may offer mediation assistance at our sole discretion.
  • In no event shall mybeautymaster's total aggregate liability to any User exceed the total amount of platform service fees actually collected by mybeautymaster from that User in the twelve (12) months preceding the event giving rise to the claim. This limitation does not apply to the total service price paid to Service Providers.
  • The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • mybeautymaster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of or inability to use the Platform.
  • mybeautymaster is not responsible for service interruptions, system failures, data loss, network outages, or any damages resulting from force majeure events.

11. Intellectual property

  • All content, design, text, graphics, logos, icons, software, source code, and other materials on the Platform (collectively, "Platform Content") are owned by or licensed to mybeautymaster and are protected by Canadian and international intellectual property laws. All rights are reserved.
  • Service Providers retain full ownership of their own content, including portfolio images, service descriptions, and business information they upload to the Platform.
  • By uploading content to the Platform, Users grant mybeautymaster a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, and distribute such content solely for the purpose of operating, promoting, and improving the Platform. This licence terminates when the User deletes the content or their account, except where the content has been shared with or relied upon by other Users.
  • Users must not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on any Platform Content without prior written permission from mybeautymaster.
  • The mybeautymaster name, logo, and all related trademarks, service marks, and trade dress are the exclusive property of mybeautymaster and may not be used without express written consent.

12. Dispute resolution

In the event of a dispute between a Customer and a Service Provider, the parties agree to the following process:

  1. Direct resolution. The parties should first attempt to resolve the dispute directly through the Platform's messaging system or by other reasonable means.
  2. Platform mediation. If direct resolution is unsuccessful, either party may submit a dispute to mybeautymaster through the Platform's support channels. Disputes must be reported within forty-eight (48) hours of the service date. mybeautymaster may, at its sole discretion, review the dispute and issue credits, partial refunds, or full refunds as it deems appropriate.
  3. Binding arbitration. If the dispute cannot be resolved through mediation, it shall be finally resolved by binding arbitration administered in accordance with the applicable arbitration rules of the province in which mybeautymaster is domiciled. The arbitration shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties.

Class action waiver. To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against mybeautymaster.

13. Termination

  • Users may delete their account at any time through the Platform's account settings or by contacting mybeautymaster support.
  • mybeautymaster reserves the right to suspend, restrict, or permanently terminate any User account, without prior notice, for violations of these Terms, fraudulent activity, behaviour that poses a safety risk, or any other reason at our sole discretion.
  • Termination of an account does not release either party from any payment obligations, liabilities, or claims that arose prior to or as a result of the termination.
  • Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 10 (Marketplace Liability), 11 (Intellectual Property), 12 (Dispute Resolution), and 15 (Governing Law).

14. Modifications to terms

mybeautymaster reserves the right to modify, amend, or replace these Terms at any time at its sole discretion. When we make material changes, we will notify Users by email, in-app notification, or by prominently posting a notice on the Platform.

The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Platform after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Platform and, if applicable, delete your account.

15. Governing law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

The courts of the Province of Quebec shall have exclusive jurisdiction over any legal proceedings arising out of or relating to these Terms, and you hereby irrevocably consent to the jurisdiction of such courts.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
